Terms of Use

1. General provisions
Welcome to the Sophelle Academy platform. By accessing and using our platform, you accept these Terms of Use in full. Please read them carefully.
Sophelle Academy (the "Platform", "we", "us") is an online education platform focused on makeup training, connecting educators with students.
The platform is operated by Sophies Choice Shop d.o.o. Beograd-Savski venac, registered at Karađorđeva 69, 11000 Belgrade, Serbia (Tax ID 110906050, Registration number 21400319). Full business details are also shown in the site footer.
2. Registration and account
To use certain platform features, you need to create an account. During registration, you agree to:
- Provide accurate and complete information
- Keep your password secure
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities under your account
3. Purchases and access to courses
When you purchase a course on our platform, you receive access for the duration stated on the product page and confirmed during checkout. When access is unlimited, that is explicitly marked. Access is limited to one user and may not be shared or transferred to another person.
Personal access and no sharing: Your account and access to purchased content are strictly personal. Sharing account credentials with third parties, as well as any unauthorized distribution or sharing of video materials and other platform content, is prohibited.
If we suspect unauthorized sharing or violation of these terms, the Platform may apply protective measures, including automatic logout on other devices, temporary access restriction, or account suspension. In the event of serious or repeated violations, the Platform may permanently revoke access without refund for purchased courses.
All prices are displayed in Serbian dinars (RSD) and include VAT. The seller is a VAT payer.
Payment processing: card payments (with 3D Secure), and where available Apple Pay or Google Pay, are processed by Raiffeisen Bank (RaiAccept) as an authorized processor — you enter your card details on the bank's secure page and we do not store them. When using Apple Pay or Google Pay, the terms and privacy policies of Apple and Google respectively also apply.
Pre-contractual notice: before you confirm an order, the following information is clearly presented to you on the product page and during checkout, in accordance with the Consumer Protection Act:
- The seller's identity and contact details (full business details are shown in the site footer and in the order confirmation);
- The main characteristics of the digital content (course/lesson description, instructor, and access duration);
- The total price including all taxes, expressed in dinars (RSD), with no hidden costs;
- The payment method (payment cards with 3D Secure, or bank transfer) and the method of content delivery;
- Digital delivery: access is activated immediately after payment confirmation, with no delivery costs;
- The right of withdrawal and the statutory exception for digital content (see Section 4);
- The complaints procedure and support contact (see Section 4).
4. Right of withdrawal, refunds and complaints
Right of withdrawal: a consumer has the right to withdraw from a distance contract within 14 days, without stating a reason and without additional costs, except in cases provided by law.
Exception for digital content: for digital content delivered electronically to which access is activated immediately upon payment confirmation, by submitting your order and accepting these terms you expressly agree that delivery begins before the withdrawal period expires and you confirm that you thereby lose the right of withdrawal, in accordance with the Consumer Protection Act. This does not affect your right to file a complaint.
Refunds: a refund is available if the content has not been delivered, is not technically accessible, or materially deviates from the description. Refunds are made using the same payment method used for the purchase, no later than 14 days after the request is accepted, with no additional costs to the consumer.
Complaints: you can file a complaint by email to office@sophelle.academy or via the contact form, including the order number and a description of the problem. We confirm receipt of a complaint without delay and respond in writing (by email) no later than 8 days from receipt, stating our position on the request and proposing the manner and deadline for resolving it.
Out-of-court dispute resolution: if you are not satisfied with our response, a consumer dispute may also be resolved out of court. The list of bodies for the out-of-court resolution of consumer disputes and the competent ministry are available on the website of the ministry responsible for consumer protection.
5. Intellectual property
All content on the platform, including video materials, text, graphics, logos, and software, is protected by copyright and other intellectual property rights.
By purchasing a course, you receive a license for personal use of the content. The following is not allowed:
- Copying, distributing, or sharing content with third parties
- Recording or downloading video materials
- Using content for commercial purposes without our written consent
- Modifying content or creating derivative works
6. Rules of conduct
Platform users agree to:

- Respect other users and educators
- Not publish offensive, discriminatory, or unlawful content
- Not use the platform for spam or unwanted promotion
- Not attempt to compromise platform security
7. Limitation of liability
The platform is provided "as is" and "as available". We do not guarantee that the platform will always be available, error-free, or secure.
We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform, to the extent permitted by law.
8. Changes to the terms
We reserve the right to change these Terms of Use at any time. We will notify you of material changes by email or platform notice.
Continued use of the platform after changes take effect means you accept the updated terms.
9. Governing law
These Terms of Use are governed by the laws of the Republic of Serbia. Any disputes are subject to the jurisdiction of the courts in Belgrade.
10. “My Clients” module — client records
The platform offers professional makeup artists a “My Clients” module for keeping their own client records (contacts, appointments, payments, notes, photos). By using the module you accept the following special rules:
With regard to your clients' data, you are the data controller — you decide what data you enter and you are responsible for having a legal basis to do so (e.g. the client's consent), especially for allergy information and photos. For storing and displaying your records the platform acts as a processor (a technical storage provider) and does not use that data for any other purpose or share it with third parties. The exception is the appointment protection described below: when standardised phone numbers are automatically compared between accounts, the platform acts as a (joint) controller for that specific purpose, on the basis of the legitimate interest of protecting module users from double bookings.
Your records are visible only to you, through your account. Photos are kept in private storage and are accessible only via time-limited links. Deleting a client's card permanently removes their personal data and photos; financial totals remain in anonymised form.
If you connect your Google calendar, appointment data is written to a dedicated calendar in your Google account, and you can revoke access at any time. Treat the calendar feed link (ICS) as a secret — you can always reset it in settings and get a new one.
Appointment protection (platform-level signals): to protect all module users from double bookings, client phone numbers are automatically compared between accounts in a standardised form, solely to warn about a possible double booking (two active bookings of the same number at a close time with different users). Other users are never shown your identity, your client's data or the details of your appointments — only the fact that a signal exists. The network signal about past no-shows across different accounts is disabled by default and is not used. Subjective ratings and comments about clients are not shared or collected for sharing. Appointments can be sent to the client for confirmation via a public link that contains only the date, time and your name. Objections to the accuracy of these signals (yours or your client's) can be sent to office@sophelle.academy — we will review the disputed record and remove it if needed.
The module's core functions (appointments, client cards, expenses, calendar synchronisation and data export) are free and do not depend on your directory listing; the module's statistical reports are tied to Active status under section 11.
The module is in a pilot phase and may change. To improve it, we record basic anonymous usage indicators (e.g. number of opens and entries) — never the content of your records.
11. Makeup artist directory — public profile
The platform offers professional makeup artists the option of creating a public profile in the artist directory (name, city, services, price list, portfolio, contact). Publication is voluntary and requires your explicit consent; you can hide your profile or delete it at any time.
Profiles go through a short review before publication. We reserve the right to reject or remove a profile that violates these Terms, presents someone else's work as its own or contains inaccurate information.
Directory listing (“Active status”) is free for the first 12 months after profile approval and is extended automatically through purchases: for every 12,000 RSD of successfully charged purchases on the platform, the listing gains an additional 12 months (amounts accumulate, any surplus carries over to the next cycle, and the listing can be secured at most 12 months in advance). Refunded purchases reduce the unused amount; if the amount has already been converted into an extension, we reserve the right to proportionally reduce the remaining listing period. After the period expires, the profile remains visible for another 30 days and is then temporarily removed from the directory — data and photos are not deleted, and the listing resumes once the period is extended. Keeping records in the “My Clients” module does not depend on the directory listing; the module's statistical reports are tied to Active status.
The “Certified” badge is shown on profiles of users who hold a valid certificate for a completed course on the platform and affects the ordering of profiles in the directory. The platform does not guarantee any number of inquiries or bookings; arrangements about services, appointments and prices are made exclusively between the artist and the client, without the platform's mediation or commission.
12. Credits and gift vouchers
On the platform you can buy wallet credits (topping up your own balance) or a gift voucher with a unique code that the recipient activates on their account. Credits and vouchers are denominated in dinars and can be used exclusively to pay for digital content (courses and lessons) on the platform.
- Validity: gift vouchers and purchased credits are valid for 12 months from the date of issue. Once a voucher is activated, the resulting credits are valid for 12 months from the day of activation.
- After the validity period expires, any unclaimed value ceases to be valid and cannot be used or refunded.
- Right of withdrawal: an unused (unactivated) gift voucher may be cancelled within 14 days of purchase and refunded in full by contacting support at office@sophelle.academy. After activation (conversion into credit) or partial or full use, this right ceases because the service has begun to be used.
- Partial use: the value may be spent across multiple transactions; any unused portion remains on the balance until the validity period expires.
- Packages with physical products: credits/vouchers cover only the digital (course) part of the package, while physical products are paid by card or bank transfer. Credits cannot be exchanged for cash.
- VAT: the transaction is fiscalized at the time credits/vouchers are sold; when later spent on digital content, VAT is not charged again, except on any additional top-up amount.
